Terms of Service for FamyGram

Effective Date: August 1, 2025

These Terms of Service ("Terms") govern your access to and use of FamyGram (the "Service"), provided by

Z-Soft VOF, a company registered in Belgium ("we," "our," or "us"). By creating an account or using the

Service, you agree to these Terms.

1. Service Overview

FamyGram is a SaaS application that allows families to manage and display digital content on a shared

family screen. Key features include:

- Calendar event management

- To-do list organization

- Integration with third-party photo storage services for displaying images

FamyGram is intended for family use, with account holders being adults (18+). Children may view the shared

screen or use the companion app under adult supervision but may not create or manage accounts.

2. Account Registration and Access

- Each adult user must create their own account using an email address or supported third-party login

(Google, Apple, Microsoft, etc.).

- Users must provide accurate and current information.

- Accounts are personal and may not be shared.

- Users are responsible for maintaining the security of their login credentials.

3. User Content

- You retain full ownership of the content you add to FamyGram (e.g., calendar events, to-do lists).

- By using the Service, you grant us a limited, non-exclusive license to store, process, and display your

content solely to operate the Service.

- Photos displayed via FamyGram are accessed only from authorized third-party services and are not stored

permanently by us unless explicitly required to provide the service.

4. Prohibited Activities

Users must not:

- Upload, share, or link to illegal, harmful, hateful, or offensive material.

- Use the Service for unlawful purposes or to violate the rights of others.

- Attempt to hack, disrupt, or interfere with the Service's functionality.

Violation of these rules may result in suspension or termination of your account.

5. Subscriptions, Donations, and Payments

- FamyGram is currently free to use. Donations are voluntary and non-refundable.

- In the future, we may introduce premium plans with free trial periods. Any fees will be clearly communicated

in advance.

- Payments for premium features, once processed, are non-refundable.

6. Data Collection and Privacy

- We collect personal information (e.g., email addresses, family member names, and relationships) necessary

to provide the Service.

- All user data is stored and processed within the European Union in compliance with GDPR.

- The Service may connect to third-party providers (e.g., Google, OneDrive) with your explicit authorization.

We access only the data necessary for the agreed functionality.

7. Service Availability and Disclaimer

- We strive to provide a reliable Service but do not guarantee uninterrupted availability or error-free operation.

- The Service is provided on an "as-is" basis, without warranties of any kind.

8. Limitation of Liability

- To the maximum extent permitted by Belgian law, Z-Soft VOF is not liable for any indirect, incidental, or

consequential damages arising from your use of FamyGram.

- We are not responsible for:

- Data loss or corruption

- Unauthorized access to your account (if caused by your actions)

- Issues resulting from third-party integrations

9. Account Suspension and Termination

We may suspend or terminate your account if:

- You violate these Terms

- You engage in illegal or harmful activities

- Your account remains inactive for an extended period (minimum 12 months)

We may also terminate the Service entirely with prior notice to active users.

10. Dispute Resolution and Governing Law

- We encourage users to first attempt to resolve disputes with us informally by contacting our support team at

info@z-soft.be.

- If no resolution is reached, disputes will be handled under Belgian law in the competent courts of Belgium.

11. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify users before they
